1 Policy

Threadline News respects copyright and responds to notices under section 512 of the Digital Millennium Copyright Act. Material we host that is identified in a valid notice is removed or disabled promptly, and the person who posted or supplied it is told why.

Government and court records on our document pages are public-domain works of the United States; a notice about one of those should say what is claimed to be protected, because the record itself is not.

2 Designated agent

3 What a notice must contain

Section 512(c)(3) requires all of the following:

1. 1A physical or electronic signature of the copyright owner or a person authorised to act for them.
2. 2Identification of the copyrighted work claimed to be infringed.
3. 3Identification of the material claimed to be infringing, with enough information for us to locate it, such as its URL.
4. 4Your contact information: address, telephone number and email address.
5. 5A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
6. 6A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorised to act for the owner.

An incomplete notice is answered with what is missing rather than ignored.

4 Counter-notices

If material you supplied is removed and you believe the removal was a mistake or misidentification, you may send a counter-notice to the same agent containing your signature, identification of the removed material and where it appeared, a statement under penalty of perjury of your good-faith belief, your contact details, and consent to the jurisdiction of your federal district court. Unless the claimant files a court action, removed material may be restored in 10 to 14 business days.

5 Repeat infringers

Where the site carries material supplied by others, an account or supplier repeatedly subject to valid notices is terminated. Misrepresentation in a notice or counter-notice carries liability under section 512(f).
